URDU–THE UTILITY & SIGNIFICANCE OF HUDOOD O TAAZEERAT IN JUDICIAL STABILITY (ANALYTICAL STUDY)
Abstract
No society can flourish without provision of justice to each and every member of community. Justice can be maintained only when the court is stable and powerful in a society. The strength of court is dependent on the immediate and inexpensive delivery of justice. All should be considered equal as regards constitution and no one should be deemed superior to legislation on basis of favoritism, nepotism, or authority. Only the real offender should be punished according to the crime he committed. The decision of court should be in alliance with constitution instead of any prejudice or favor towards any party. Islamic code of conduct actually propagates all these above mentioned characteristics and therefore ensures a stable and secure system of justice along with superiority of court. But this thing is of utmost significance that the Islamic system of Hudood and Taazeerat may be implemented in letter and spirit. Only then, it would be possible for the humanity at large to get benefit from it the right way. It will not only lead the judicial stability in the Islamic State but also strengthen it in terms of economy, social setup and politics.
